1.Introduction

These Terms & Conditions (“Terms”) apply to the Miles mobile application available on the Apple App Store (iOS) (“App”). The App is developed and operated by Appmetric Software Private Limited (“Miles”, “we”, “us”, or “our”).

By downloading, installing, or using the App, you agree to be bound by and comply with these Terms, including any additional policies referenced herein. These Terms should be read alongside our Privacy Policy.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. BY DOWNLOADING, INSTALLING, OR ACCESSING THE APP, YOU ACCEPT AND AGREE TO THESE TERMS, WHICH ARE LEGALLY BINDING. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THE APP.

2.General Information

Miles is a personalised running app designed for runners of all levels — from beginners taking their first steps to advanced athletes chasing personal bests. Key features of the App include:

  • Real-time individual pace tracking tailored to your running profile;
  • Customised training plans generated based on your performance data; and
  • General running tips, guidance, and support.

You may download and use the App provided you are aged 18 or older. We may delete your account (and associated data) if you are found to be under such age.

We may add to, discontinue, or suspend any part of our service at any time at our sole discretion, including where we need to protect the App and its users.

3.App Updates and Functionality

We may make updates to the App available from time to time to add features or fix bugs. We recommend that you keep the App updated, as older versions may not function correctly.

The App is provided over the Internet and its quality and availability may be affected by factors outside our control. We are not responsible for any connectivity issues you may experience. You are responsible for obtaining a compatible device and for any data charges levied by your network provider.

Like all applications, the App may include bugs or errors from time to time. While we aim to fix known issues, we do not guarantee that the App will be error-free at all times.

The App may include integrations with third-party services (such as Apple Health, Strava, or Garmin Connect). As these connections depend on third parties: (a) we do not accept responsibility for them; and (b) they may stop working or be removed at our discretion, without refund.

4.Apple App Store Terms

You agree to comply with the Apple Media Services Terms and Conditions when making use of the App.

You acknowledge that:

  • The availability of the App is dependent on the Apple App Store from which you downloaded it;
  • These Terms are between you and Miles, and not with Apple;
  • Apple is not responsible for the App, its content, maintenance, support, or warranty, nor for addressing any related claims; and
  • Apple and its subsidiaries are third-party beneficiaries to these Terms and have the right to enforce them against you.

5.Not Medical or Professional Advice

The content provided within the App is for informational and general guidance purposes only. It is not intended to substitute professional medical advice, diagnosis, treatment, or professional coaching. You expressly agree that Miles is not providing medical or professional advice as part of the App.

You should always:

  • Seek the advice of your physician or qualified health provider before starting any new training plan or exercise programme, particularly if you have a pre-existing medical condition; and
  • Not disregard or delay seeking professional medical advice because of something you have read or seen within the App.

Your use of the App does not create a doctor-patient or any other professional healthcare relationship between you and Miles.

6.Permitted Use

You agree to use the App only as permitted by these Terms and in compliance with all applicable laws, regulations, and generally accepted practices in your country of residence. The licence granted to you is personal, non-commercial, non-exclusive, and non-transferable.

You will not (and will not attempt to):

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the App;
  • Copy, reproduce, or otherwise make available any contents of the App in any form or by any means;
  • Use the App for any illegal or unlawful purpose;
  • Access the App by any means other than through the interface provided by Miles, including via automated means such as scripts or bots;
  • Gain unauthorised access to our systems or engage in any activity that interferes with or impairs the App's performance or security; or
  • Reproduce, duplicate, or sell any aspect of the App or any content bearing the Miles name, trademark, or logo.

7.Subscriptions & Cooling-Off Periods

We may from time to time offer a free trial of the App. Free trials may only be used once and by first-time users only. The duration of any trial will be specified at the time of sign-up.

When subscribing, you will be required to select your preferred subscription term. Please review your selection carefully before completing your purchase. Your subscription cannot be modified until its expiration or renewal date.

By purchasing a subscription, you are specifically requesting that the App be made immediately available to you. Where applicable law provides for a cooling-off or cancellation period, your acknowledgement of immediate access will waive your right to cancel during that period.

8.Payments & Refunds

Payment for your subscription is processed by the Apple App Store, in accordance with the subscription type you have selected (for example, monthly or annually).

You can stop the auto-renewal of your subscription at any time via the Manage Subscriptions tab in your Apple App Store account. We recommend turning off auto-renewal at least 24 hours before your renewal date to avoid being billed for the next period.

Once auto-renewal is turned off, you will retain access to the App for the remainder of your current subscription period. No refunds are available for unused portions of your subscription period, except as required by applicable law.

We may terminate your subscription and/or account at any time. We will contact you via email if we take such action and will explain the reason.

Where we terminate:

  • Due to your breach of these Terms: you will not be eligible for a refund; or
  • For any other reason: you will be entitled to a pro-rated refund for any pre-paid amounts.

Please email us at support@milesapp.run if you believe your account has been closed incorrectly.

9.Referral Codes

Referral codes may be made available from time to time, offering benefits such as extended free trials or discounts. These codes are provided at Miles's sole discretion and on the terms communicated alongside the code.

We may withdraw or modify referral codes at any time without notice or reimbursement.

10.Intellectual Property Rights

We grant you a limited, personal, non-commercial licence to use the App for your own personal use. The App and all content included within it — including text, images, sounds, videos, pace algorithms, and training plan frameworks — is the intellectual property of Miles and its licensors.

Except as expressly set out in these Terms, you acquire no rights to any such intellectual property.

11.Disclaimer

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MILES EXPRESSLY DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING: (A) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AS TO THE APP AND ITS CONTENT; (B) WARRANTIES ARISING THROUGH COURSE OF DEALING; AND (C) WARRANTIES OF UNINTERRUPTED OR ERROR-FREE ACCESS OR USE. THE APP AND ALL CONTENT IS PROVIDED ON AN “AS IS” BASIS AND YOUR USE IS AT YOUR OWN RISK.

12.Limitation of Liability

Our liability to you in connection with your use of the App is limited to the maximum extent permitted by law in your country of residence. We are not responsible for any consequential, special, indirect, or incidental damages arising out of your use of the App, even if we were made aware that such losses might arise.

You acknowledge that running and athletic activities carry inherent and significant risks, including property damage, bodily injury, or death. You agree, to the maximum extent permitted by law, to:

  • Voluntarily assume all known and unknown risks associated with your athletic activities, even if caused in whole or in part by the action, inaction, or negligence of Miles; and
  • Release Miles and its representatives, employees, and partners from any and all liability in connection with your athletic activities or use of the App.

Our aggregate liability to you will not exceed the amount you have paid to us in the past 12 months.

13.Indemnification

You agree to indemnify and hold Miles and its representatives harmless from any claim, demand, or loss (including reasonable legal fees) arising from any third-party claim connected to:

  • Your breach of these Terms; or
  • Your violation of the rights of any third party, including intellectual property, privacy, or confidentiality rights.

14.Termination

If you breach these Terms, we may terminate your right to use the App. We will notify you of the termination and the reasons for it. You will not be entitled to a refund upon termination due to breach.

15.Changes to These Terms

We reserve the right to update these Terms from time to time. The “Last Updated” date at the top of this document will reflect any changes. Your continued use of the App after any such update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16.Other Terms

By using the App, you confirm that you are not located in a country subject to any applicable government embargo or international trade restriction.

You consent to receive communications from us electronically. All agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

If any of these Terms are found to be invalid or unenforceable, that provision will be deemed severable and will not affect the validity of the remaining Terms.

A failure to act on a breach of these Terms does not waive the right to act on subsequent or similar breaches.

17.Dispute Resolution & Governing Law

In the event of a dispute arising out of or in connection with these Terms, you agree to first attempt to resolve the matter in good faith by contacting us at support@milesapp.run before pursuing any further action.

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising under these Terms will be subject to the jurisdiction of the courts of India.
